1. Agreement to Terms

Please read these Terms and Conditions (“Terms”) carefully before using Alpha1Convert.com (the “Service”), operated by Alpha1Convert (“us,” “we,” or “our”).

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.

By accessing or using the Service, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated into these Terms by reference. If you disagree with any part of these Terms, you must discontinue use of the Service immediately.

These Terms constitute the entire agreement between you and us regarding the Service and supersede any prior agreements.


2. Eligibility

The Service is not directed to children under the age of 13. By using the Service, you represent and warrant that you are at least 13 years of age. If you are between the ages of 13 and the age of legal majority in your jurisdiction, you represent that you have your parent or legal guardian’s permission to use the Service and that they have read and agree to these Terms on your behalf.

If we become aware that a user under the age of 13 has provided personal information to us without parental consent, we will take steps to remove that information consistent with our Privacy Policy.

You further represent that you have the legal capacity to enter into a binding agreement, and that your use of the Service does not violate any applicable law in your jurisdiction.


3. Description of the Service

Alpha1Convert provides a free, browser-based online tool for converting files from one format to another (the “Service”). The Service is provided for personal, non-commercial convenience use unless otherwise agreed in writing.

We do not guarantee that any specific file format, conversion type, or feature will always be available. We reserve the right to add, modify, limit, or discontinue any feature of the Service, including supported file types, at any time without notice or liability.

The Service may currently impose a maximum file size limit (presently 2GB per file) and may impose additional usage limits, rate limits, or restrictions at our sole discretion to prevent abuse and ensure fair access for all users. These limits may change at any time without prior notice.


4. File Ownership, License, and File Handling

4.1 You Own Your Files

When you use the Service, you upload files to our servers for the sole purpose of conversion. Your files remain yours. These Terms do not transfer any ownership rights in your files to us.

4.2 Limited License Granted to Us

By uploading a file to the Service, you grant us a limited, temporary, non-exclusive, royalty-free license to access, store, process, and convert that file solely for the purpose of providing the Service to you. This license exists only for as long as is necessary to perform the requested conversion and applicable temporary storage, as described below, and automatically terminates upon deletion of the file.

We do not access, view, read, analyze, or use the contents of your files for any purpose other than performing the conversion you requested, except as may be required to comply with applicable law or to investigate violations of these Terms.

4.3 Automatic File Deletion

To protect your privacy and minimize data retention, files are handled on the following schedule:

  • Source files (the file you upload) are automatically and permanently deleted from our servers immediately upon completion of the conversion job.
  • Destination files (the converted output file) are automatically and permanently deleted from our servers 1 hour after the conversion job completes.
  • You may manually delete your converted file at any time before this automatic deletion occurs.

You acknowledge that once a file is deleted under this schedule, it cannot be recovered. We strongly recommend that you download your converted file promptly and maintain your own backup copies of all original files. We are not responsible for any loss of files, data, or content resulting from this deletion schedule or from any other cause.


5. Acceptable Use Policy

You agree that you will not use the Service for any purpose that is unlawful or prohibited by these Terms. Without limiting the foregoing, you agree that you will not, and will not attempt to:

  • Upload, convert, store, or distribute any content that infringes the copyright, trademark, trade secret, privacy, publicity, or other intellectual property or proprietary rights of any third party.
  • Upload or process any content you do not own or do not have express legal authorization to use, copy, or convert.
  • Use the Service to circumvent, bypass, remove, or disable any digital rights management (DRM) technology, copy-protection mechanism, or other technological protection measure (TPM) applied to content, including but not limited to content sourced from streaming, subscription, or media platforms.
  • Upload, convert, or distribute any content that is unlawful, defamatory, obscene, pornographic involving minors, harassing, hateful, or that promotes violence, discrimination, or illegal activity.
  • Upload any file containing malware, viruses, ransomware, spyware, or any other malicious code intended to damage, disrupt, or gain unauthorized access to any system.
  • Use any automated system, bot, scraper, or script to access the Service in a manner that sends more requests than a human could reasonably produce, or to circumvent any rate, file size, or usage limits.
  • Attempt to gain unauthorized access to any portion of the Service, other users’ files, or any systems or networks connected to the Service.
  • Reverse engineer, decompile, or disassemble any portion of the Service, except where such restriction is prohibited by applicable law.
  • Use the Service in any manner that could disable, overburden, damage, or impair the Service or interfere with any other party’s use of the Service.
  • Resell, sublicense, or commercially redistribute access to the Service without our prior written consent.

Violation of this Acceptable Use Policy may result in immediate suspension or termination of your access to the Service, removal of content, and may be reported to law enforcement or relevant authorities where appropriate.


6. Copyright Policy and DMCA Compliance

6.1 User Responsibility

You are solely responsible for ensuring that you have the legal right to upload, convert, and use any content you submit to the Service. You agree that you will not upload any content that infringes the copyright or other intellectual property rights of any third party.

6.2 Prohibition on DRM Circumvention

Alpha1Convert strictly prohibits the use of the Service to circumvent digital rights management (DRM) systems or other copy-protection measures, including but not limited to ripping, decrypting, or converting protected content obtained from streaming services, paid media platforms, or other DRM-protected sources without proper authorization from the rights holder. Use of the Service for such purposes is a material breach of these Terms.

6.3 Monitoring and Enforcement

While we do not actively monitor all content processed through the Service, we reserve the right, in our sole discretion, to review, remove, or disable access to any content that we believe violates these Terms or applicable law, including content that infringes intellectual property rights, without prior notice.

6.4 DMCA Takedown Notices

Alpha1Convert is a service provider as defined under 17 U.S.C. § 512 of the Digital Millennium Copyright Act (“DMCA”). If you believe that content processed through or stored on the Service infringes your copyright, you may submit a takedown notice to us. To be effective, your notice must include:

  1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  2. Identification of the copyrighted work claimed to have been infringed.
  3. Identification of the allegedly infringing material and information reasonably sufficient to permit us to locate it.
  4. Your contact information, including your address, telephone number, and email address.
  5. A statement that you have a good faith belief that use of the material is not authorized by the copyright owner, its agent, or the law.
  6. A statement, made under penalty of perjury, that the information in the notification is accurate and that you are authorized to act on behalf of the copyright owner.

6.5 Counter-Notification

If you believe that content you submitted was removed or disabled as a result of mistake or misidentification, you may submit a counter-notification containing:

  1. Your physical or electronic signature.
  2. Identification of the material that was removed and its location before removal.
  3. A statement, under penalty of perjury, that you have a good faith belief the material was removed as a result of mistake or misidentification.
  4. Your name, address, telephone number, and email address.
  5. A statement that you consent to the jurisdiction of the federal court in your district (or, if outside the United States, the jurisdiction where Alpha1Convert is located), and that you will accept service of process from the party who filed the original notice.

6.6 Repeat Infringers

We will terminate, in appropriate circumstances, the access of users who are determined to be repeat infringers.


7. Intellectual Property

The Service, including its design, layout, text, graphics, logos, software, and underlying technology (excluding user-submitted files), is and will remain the exclusive property of Alpha1Convert and its licensors. The Service is protected by copyright, trademark, and other applicable laws.

Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent. You may access and use the Service for your personal, non-commercial use only. You may not copy, modify, distribute, sell, or lease any part of the Service or its underlying software without our express written permission.


8. Third-Party Links and Advertising

The Service may contain links to third-party websites or services that are not owned or controlled by Alpha1Convert, and may display advertisements served by third-party advertising networks, including Google AdSense.

Alpha1Convert has no control over, and assumes no responsibility for, the content, accuracy, privacy policies, or practices of any third-party websites, services, or advertisements. You acknowledge and agree that Alpha1Convert shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with your use of or reliance on any third-party content, products, services, or advertisements accessible through the Service.

Advertisements displayed on the Service through Google AdSense are subject to Google’s advertising practices, which are described in our Privacy Policy. We do not control the content of third-party advertisements and do not endorse any products or services advertised through the Service.

We strongly advise you to review the terms of service and privacy policies of any third-party website or service you visit through links on the Service.


9. Disclaimer of Warranties

YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

Alpha1Convert does not warrant that: (a) the Service will be uninterrupted, timely, secure, or error-free; (b) the results obtained from using the Service will be accurate, complete, or reliable; (c) any file converted through the Service will retain perfect fidelity to the original file’s formatting, quality, or content; or (d) any errors or defects in the Service will be corrected.

File conversion accuracy depends on numerous factors outside our control, including the format, quality, and structure of the source file. You are solely responsible for reviewing and verifying the accuracy and suitability of any converted file before relying on or distributing it. We strongly recommend maintaining backup copies of all original files.

No advice or information, whether oral or written, obtained from us or through the Service shall create any warranty not expressly stated in these Terms.


10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ALPHA1CONVERT, ITS OWNERS, OFFICERS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF FILES, LOSS OF PROFITS, LOSS OF BUSINESS OPPORTUNITY, OR LOSS OF GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT Alpha1Convert HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

WHERE WARRANTIES ARE IMPLIED BY LAW AND CANNOT BE FULLY EXCLUDED, YOU ACKNOWLEDGE AND AGREE THAT OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS ($100.00) OR THE TOTAL AMOUNT, IF ANY, YOU PAID TO US FOR USE OF THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM. THIS LIMITATION APPLIES EVEN IF THE SERVICE WAS PROVIDED TO YOU FREE OF CHARGE.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU. IN SUCH JURISDICTIONS, OUR LIABILITY SHALL BE LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW.

This limitation of liability applies to the fullest extent permitted by law and shall survive any termination or expiration of these Terms or your use of the Service.


11. Indemnification

You agree to indemnify, defend, and hold harmless Alpha1Convert and its owners, officers, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with: (a) your access to or use of the Service; (b) any content you upload, convert, or distribute through the Service; (c) your violation of these Terms or any applicable law; or (d) your infringement of any intellectual property or other right of any third party.


12. Termination

We may suspend or terminate your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including, without limitation, if you breach these Terms, engage in prohibited conduct under our Acceptable Use Policy, or if we are required to do so by law.

Upon termination, your right to use the Service will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including, without limitation, ownership provisions, warranty disclaimers, indemnification obligations, and limitations of liability.

You may discontinue use of the Service at any time. If accounts are introduced in the future, you will be able to request deletion of your account in accordance with our Privacy Policy.


13. Future Paid Plans and Billing

The Service is currently provided free of charge. We may, at our discretion, introduce optional paid subscription plans, one-time purchases, or premium features in the future. If and when we do, these Terms will be updated to include applicable billing terms, including payment processing, renewal, cancellation, and refund policies, prior to any such plans becoming available. Your continued use of the Service after such an update constitutes acceptance of the revised Terms.

Any future paid plans will clearly disclose pricing, billing frequency, and cancellation procedures before you are charged.


14. Modifications to the Service

We reserve the right to modify, suspend, or discontinue the Service, or any part of it, at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.


15. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of California and applicable United States federal law, without regard to conflict of law principles.

Any dispute arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the state and federal courts located in California, and you consent to the personal jurisdiction of such courts.

Our failure to enforce any right or provision of these Terms shall not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, that provision shall be enforced to the maximum extent permissible, and the remaining provisions of these Terms will remain in full force and effect.


16. Changes to These Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will make reasonable efforts to provide notice prior to any new terms taking effect, such as by posting a notice on the Service or updating the “Last Updated” date above. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use the Service after any revisions become effective, you agree to be bound by the revised Terms. If you do not agree to the new Terms, you must stop using the Service.


17. Relationship to Our Privacy Policy

Our collection and use of personal information in connection with the Service is described in our Privacy Policy, which is incorporated into these Terms by reference. By agreeing to these Terms, you also agree to the terms of our Privacy Policy, including but not limited to our use of cookies, analytics tools (such as self-hosted Matomo and, where enabled, Google Analytics), and advertising technologies (such as Google AdSense).

In the event of any conflict between these Terms and the Privacy Policy regarding the handling of personal data, the Privacy Policy shall govern.


18. Miscellaneous

18.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding your use of the Service and supersede any prior agreements between you and us regarding the Service.

18.2 No Unlawful or Prohibited Use

As a condition of your use of the Service, you warrant that you will not use the Service for any purpose that is unlawful or prohibited by these Terms.

18.3 Assignment

You may not assign or transfer these Terms, by operation of law or otherwise, without our prior written consent. We may assign these Terms, in whole or in part, without restriction, including in connection with a merger, acquisition, or sale of assets.

18.4 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

18.5 No Waiver

Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
